第一章 总 则
第一条 为了加强商标管理,保护商标专用权,促使生产者保证商品质量和 维护商标信誉,以保障消费者的利益,促进社会主义商品经济的发展,特制定本 法。
第二条 国务院工商行政管理部门商标局主管全国商标注册和管理的工作。
第三条 经商标局核准注册的商标为注册商标,商标注册人享有商标专用权 ,受法律保护。
第四条 企业、事业单位和个体工商业者,对其生产、制造、加工、拣选或 者经销的商品,需要取得商标专用权的,应当向商标局申请商品商标注册。
企业、事业单位和个体工商业者,对其提供的服务项目,需要取得商标专用 权的,应当向商标局申请服务商标注册。
本法有关商品商标的规定,适用于服务商标。
第五条 国家规定必须使用注册商标的商品,必须申请商标注册,未经核准 注册的,不得在市场销售。
第六条 商标使用人应当对其使用商标的商品质量负责。各级工商行政管理 部门应当通过商标管理,监督商品质量,制止欺骗消费者的行为。
第七条 商标使用的文学、图形或者其组合,应当有显著特征,便于识别。 使用注册商标的,并应当标明“注册商标”或者注册标记。
第八条 商标不得使用下列文字、图形:
(1)同中华人民共和国的国家名称、国旗、国徽、军旗、勋章相同或者近 似的;
(2)同外国的国家名称、国旗、国徽、军旗相同或者近似的;
(3)同政府间国际组织的旗帜、徽记、名称相同或者近似的;
(4)同“红十字”、“红新月”的标志、名称相同或者近似的;
(5)本商品的通用名称和图形;
(6)直接表示商品的质量、主要原料、功能、用途、重量、数量及其他特 点的;
(7)带有民族歧视性的;
(8)夸大宣传并带有欺骗性的;
(9)有害于社会主义道德风尚或者有其他不良影响的。
县级以上行政区划的地名或者公众知晓的外国地名,不得作为商标,但是, 地名具有其他含义的除外;已经注册的使用地名的商标继续有效。
第九条 外国人或者外国企业在中国申请商标注册的,应当按其所属国和中 华人民共和国签订的协议或者共同参加的国际条约办理,或者按对等原则办理。
第十条 外国人或者外国企业在中国申请商标注册和办理其他商标事宜的, 应当委托国家指定的组织代理。
第二章 商标注册的申请
第十一条 申请商标注册的,应当按规定的商品分类表填报使用商标的商品 类别和商品名称。
第十二条 同一申请人在不同类别的商品上使用同一商标的,应当按商品分 类表提出注册申请。
第十三条 注册商标需要在同一类的其他商品上使用的,应当另行提出注册 申请。
第十四条 注册商标需要改变文字、图形的,应当重新提出注册申请。
第十五条 注册商标需要变更注册人的名义、地址或者其他注册事项的,应 当提出变更申请。
第三章 商标注册的审查和核准
第十六条 申请注册的商标,凡符合本法有关规定的,由商标局初步审定, 予以公告。
第十七条 申请注册的商标,凡不符合本法有关规定或者同他人在同一种商 品或者类似商品上已经注册的或者初步审定的商标相同或者近似的,由商标局驳 回申请,不予公告。
第十八条 两个或者两个以上的申请人,在同一种商品或者类似商品上,以 相同或者近似的商标申请注册的,初步审定并公告申请在先的商标;同一天申请 的,初步审定并公告使用在先的商标,驳回其他人的申请,不予公告。
第十九条 对初步审定的商标,自公告之日起三个月内,任何人均可以提出 异议。无异议或者经裁定异议不能成立的,始予核准注册,发给商标注册证,并 予公告;经裁定异议成立的,不予核准注册。
第二十条 国务院工商行政管理部门设立商标评审委员会,负责处理商标争 议事宜。
第二十一条 对驳回申请、不予公告的商标,商标局应当书面通知申请人。 申请人不服的,可以在收到通知十五天内申请复审,由商标评审委员会做出终局 决定,并书面通知申请人。
第二十二条 对初步审定、予以公告的商标提出异议的,商标局应当听取异 议人和申请人陈述事实和理由,经调查核实后,做出裁定。当事人不服的,可以 在收到通知十五天内申请复审,由商标评审委员会做出终局裁定,并书面通知异 议人和申请人。
第四章 注册商标的续展、转让和使用许可
第二十三条 注册商标的有效期为十年,自核准注册之日起计算。
第二十四条 注册商标有效期满,需要继续使用的,应当在期满前六个月内 申请续展注册;在此期间未能提出申请的,可以给予六个月的宽展期。宽展期满 仍未提出申请的,注销其注册商标。
每次续展注册的有效期为十年。
续展注册经核准后,予以公告。
第二十五条 转让注册商标的,转让人和受让人应当共同向商标局提出申请 。受让人应当保证使用该注册商标的商品质量。
转让注册商标经核准后,予以公告。
第二十六条 商标注册人可以通过签订商标使用许可合同,许可他人使用其 注册商标。许可人应当监督被许可人使用其注册商标的商品质量。被许可人应当 保证使用该注册商标的商品质量。
经许可使用他人注册商标的,必须在使用该注册商标的商品上标明被许可人 的名称和商品产地。
商标使用许可合同应当报商标局备案。
第五章 注册商标争议的裁定
第二十七条 已经注册的商标,违反本法第八条规定的,或者是以欺骗手段 或者其他不正当手段取得注册的,由商标局撤销该注册商标;其他单位或者个人 可以请求商标评审委员会裁定撤销该注册商标。
除前款规定的情形外,对已经注册的商标有争议的,可以自该商标经核准注 册之日起一年内,向商标评审委员会申请裁定。
商标评审委员会收到裁定申请后,应当通知有关当事人,并限期提出答辩。
第二十八条 对核准注册前已经提出异议并经裁定的商标,不得再以相同的 事实和理由申请裁定。
第二十九条 商标评审委员会做出维持或者撤销注册商标的终局裁定后,应 当书面通知有关当事人。
第六章 商标使用的管理
第三十条 使用注册商标,有下列行为之一的,由商标局责令限期改正或者 撤销其注册商标:
(1)自行改变注册商标的文字、图形或者其组合的;
(2)自行改变注册商标的注册人名义、地址或者其他注册事项的;
(3)自行转让注册商标的;
(4)连续三年停止使用的。
第三十一条 使用注册商标,其商品粗制滥造,以次充好,欺骗消费者的, 由各级工商行政管理部门分别不同情况,责令限期改正,并可以予以通报或者处 以罚款,或者由商标局撤销其注册商标。
第三十二条 注册商标被撤销的或者期满不再续展的,自撤销或者注销之日 起一年内,商标局对与该商标相同或者近似的商标注册申请,不予核准。
第三十三条 违反本法第五条规定的,由地方工商行政管理部门责令限期申 请注册,可以并处罚款。
第三十四条 使用未注册商标,有下列行为之一的,由地方工商行政管理部 门予以制止,限期改正,并可以予以通报或者处以罚款:
(1)冒充注册商标的;
(2)违反本法第八条规定的;
(3)粗制滥造,以次充好,欺骗消费者的。
第三十五条 对商标局撤销注册商标的决定,当事人不服的,可以在收到通 知十五天内申请复审,由商标评审委员会做出终局决定,并书面通知申请人。
第三十六条 对工商行政管理部门根据本法第三十一条、第三十三条、第三 十四条的规定做出的罚款决定,当事人不服的,可以在收到通知十五天内,向人 民法院起诉;期满不起诉又不履行的,由有关工商行政管理部门申请人民法院强 制执行。
第七章 注册商标专用权的保护
第三十七条 注册商标的专用权,以核准注册的商标和核定使用的商品为限 。
第三十八条 有下列行为之一的,均属侵犯注册商标专用权:
(1)未经注册商标所有人的许可,在同一种商品或者类似商品上使用与其 注册商标相同或者近似的商标的;
(2)销售明知是假冒注册商标的商品的;
(3)伪造、擅自制造他人注册商标标识或者销售伪造、擅自制造的注册商 标标识的;
(4)给他人的注册商标专用权造成其他损害的。
第三十九条 有本法第三十八条所列侵犯注册商标专用权行为之一的,被侵 权人可以向县级以上工商行政管理部门要求处理,有关工商行政管理部门有权责 令侵权人立即停止侵权行为,赔偿被侵权人的损失,赔偿额为侵权人在侵权期间 因侵权所获得的利润或者被侵权人在被侵权期间因被侵权所受到的损失。侵犯注 册商标专用权,未构成犯罪的,工商行政管理部门可以处以罚款。当事人对工商 行政管理部门责令停止侵权行为、罚款的处理决定不服的,可以在收到通知十五 天内,向人民法院起诉;期满不起诉又不履行的,由有关工商行政管理部门申请 人民法院强制执行。
对侵犯注册商标专用权的,被侵权人也可以直接向人民法院起诉。
第四十条 假冒他人注册商标,构成犯罪的,除赔偿被侵权人的损失外,依 法追究刑事责任。
伪造、擅自制造他人注册商标标识或者销售伪造、擅自制造的注册商标标识 ,构成犯罪的,除赔偿被侵权人的损失外,依法追究刑事责任。
销售明知是假冒注册商标的商品,构成犯罪的,除赔偿被侵权人的损失外, 依法追究刑事责任。
第八章 附 则
第四十一条 申请商标注册和办理其他商标事宜的,应当缴纳费用,具体收 费标准另定。
第四十二条 本法的实施细则,由国务院工商行政管理部门制定,报国务院 批准施行。
第四十三条 本法自1983年3月1日起施行。1963年4月10日国 务院公布的《商标管理条例》同时废止;其他有关商标管理的规定,凡与本法抵 触的,同时失效。
本法施行以前已经注册的商标继续有效。
附:全国人民代表大会常务委员会关于修改《中华人民共和国商标法》的 决定

第七届全国人民代表大会常务委员会第三十次会议审议了国务院关于《中华 人民共和国商标法修正案(草案)》的议案,决定对《中华人民共和国商标法》 作如下修改:
一、第四条修改为三款:
“企业、事业单位和个体工商业者,对其生产、制造、加工、拣选或者经销 的商品,需要取得商标专用权的,应当向商标局申请商品商标注册。
“企业、事业单位和个体工商业者,对其提供的服务项目,需要取得商标专 用权的,应当向商标局申请服务商标注册。
“本法有关商品商标的规定,适用于服务商标。”
二、第八条增加一款,作为第二款:“县级以上行政区划的地名或者公众知 晓的外国地名,不得作为商标,但是,地名具有其他含义的除外;已经注册的使 用地名的商标继续有效。”
三、第十二条修改为:“同一申请人在不同类别的商品上使用同一商标的, 应当按商品分类表提出注册申请。”
四、第二十六条增加一款,作为第二款:“经许可使用他人注册商标的,必 须在使用该注册商标的商品上标明被许可人的名称和商品产地。”
五、第二十七条第一款修改为两款:“已经注册的商标,违反本法第八条规 定的,或者是以欺骗手段或者其他不正当手段取得注册的,由商标局撤销该注册 商标;其他单位或者个人可以请求商标评审委员会裁定撤销该注册商标。
“除前款规定的情形外,对已经注册的商标有争议的,可以自该商标经核准 注册之日起一年内,向商标评审委员会申请裁定。”
六、第二十九条修改为:“商标评审委员会做出维持或者撤销注册商标的终 局裁定后,应当书面通知有关当事人。”
七、第三十八条增加一项作为第(2)项:“销售明知是假冒注册商标的商 品的”。
第三十八条第(2)项修改为第(3)项:“伪造、擅自制造他人注册商标 标识或者销售伪造、擅自制造的注册商标标识的”。
第三十八条第(3)项相应的作为第(4)项。
八、第三十九条第一款修改为:“有本法第三十八条所列侵犯注册商标专用 权行为之一的,被侵权人可以向县级以上工商行政管理部门要求处理,有关工商 行政管理部门有权责令侵权人立即停止侵权行为,赔偿被侵权人的损失,赔偿额 为侵权人在侵权期间因侵权所获得的利润或者被侵权人在被侵权期间因被侵权所 受到的损失。侵犯注册商标专用权,未构成犯罪的,工商行政管理部门可以处以 罚款。当事人对工商行政管理部门责令停止侵权行为、罚款的处理决定不服的, 可以在收到通知十五天内,向人民法院起诉;期满不起诉又不履行的,由有关工 商行政管理部门申请人民法院强制执行。”
九、第四十条修改为三款:

本决定自1993年7月1日起施行。
《中华人民共和国商标法》根据本决定作相应的修正,重新公布。

Chapter I. General ProvisionsArticle 1.This Law is enacted for the purposes of improving the administration oftrademarks, protecti ng the exclusive right to use a trademark, and ofencouraging prod ucers to guarantee the quality of their goods and maintainthe reputati on of their trademarks, with a view to protecting consumers'interest s and to promoting the development of socialist commodity economy.Arti cle 2.The Trademark Office of the administrative authority for ind ustry andcommerce under the State Council shall be responsible for th e registrationand administration of trademarks throughout the country. Article 3.A registered trademark means a trademark that has been approved andregistered by the Trademark Office. The trademark regist rant shall enjoyan exclusive right to use the trademark, which shall be protected by law.Article 4.Any enterprise, institution, or individ ual producer or trader, intendingto acquire the exclusive right to u se a trademark for the goods produced,manufactured, processed, select ed or marketed by it or him, shall file anapplication for the registr ation of the goods trademark with the TrademarkOffice.Any enterprise, institution, or individual producer or trader, intendingto acquire t he exclusive right to use a service mark for the servicesprovided by it or him, shall file an application for the registration ofthe service mark with the Trademark Office. The provisions made in this Law concerning goods trademarks shall apply to service marks.Article 5 .As for any of such goods, as prescribed by the State, that must be ar aregistered trademark, a trademark registration must be applied fo r. Whereno trademark registration has been granted, such goods cannot be sold onthe market.Article 6.Any user of a trademark shall be res ponsible for the quality of the goodsin respect of which the trademar k is used. The administrative authoritiesfor industry and commerce at different levels shall, through theadministration of tradem arks, exercise supervision over the quality of thegoods and shall stop any practice that deceives consumers.Article 7.Any word, device or th eir combination that is used as a trademark shall beso distinctive as to be distinguishable. Where a registered trademark isused, it shall carry the indication of "Registered Trademark" or a signindicating that it is registered.Article 8.In trademarks, the following words or devices shall not be used:(1) those identical with or similar to the State name, national flag,national emblem, military flag, or deco rations, of the People's Republicof China;(2) those identical with o r similar to the State names, national flags,national emblems or mi litary flags of foreign countries;(3) those identical with or similar to the flags, emblems or names, ofinternational intergovernmental organizations;(4) those identical with or similar to the symbols, or n ames, of the RedCross or the Red Crescent;(5) those relating to gene ric names or designs of the goods in respect ofwhich the trademark is used;(6) those having direct reference to the quality, main raw materials,function, use, weight, quantity or other features of the goo ds in respectof which the trademark is used;(7) those having the natu re of discrimination against any nationality;(8) those having the natu re of exaggeration and fraud in advertisinggoods; and(9) those d etrimental to socialist morals or customs, or having otherunhealt hy influences.The geographical names as the administrative divisions at or above thecounty level and the foreign geographical names well -known to the publicshall not be used as trademarks, but such geo graphical names as haveotherwise meanings shall be exclusive. Where a trademark using any of theabove-mentioned geographical names has b een approved and registered, itshall continue to be valid.Article 9 .Any foreigner or foreign enterprise intending to apply for theregistration of a trademark in China shall file an applic ation inaccordance with any agreement concluded between the People's Republic ofChina and the country to which the applicant belongs, or according to theinternational treaty to which both countries are part ies, or on the basisof the principle of reciprocity.Article 10.Any f oreigner or foreign enterprise intending to apply for there gistration of a trademark or for any other matters concerning atrademark in China shall entrust any of such organizations as desi gnatedby the State to act as his or its agent.
Chapter II. Application for Trademark RegistrationArticle 11.An applicant for the registration of a trademark shall, in a for m,indicate, in accordance with the prescribed classification of goods , theclass of the goods and the designation of the goods in respect of whichthe trademark is to be used.Article 12.Where any applicant i ntends to use the same trademark for goods indifferent classes , an application for registration shall be filed inrespect of ea ch class of the prescribed classification of goods.Article 13.Where a registered trademark is to be used in respect of other goods ofthe same class, a new application for registration shall be filed.Article 14.Where any word or device of a registered trademark is to be altered , a newregistration shall be applied for.Article 15.Where, after the r egistration of a trademark, the name, address or otherregistered ma tters concerning the registrant change, an applicationregarding the change shall be filed.
Chapter III.Examination for and Approval of Trademark Registrat ionArticle 16.Where a trademark the registration of which has been ap plied for is inconformity with the relevant provisions of this Law, the Trademark Officeshall, after examination, preliminarily approve the trademark and publishit.Article 17.Where a trademark the registra tion of which has been applied for is not inconformity with the releva nt provisions of this Law, or it is identicalwith or similar to the trademark of another person that has, in respect ofthe same or sim ilar goods, been registered or, after examination,preliminarily approved, the Trademark Office shall refuse the applicationand shall not publish the said trademark.Article 18.Where two or more applicants apply for the registration of identical orsimilar trademarks for the same or similar goods, the preliminaryapproval, after exam ination, and the publication shall be made for thetrademark which was first filed. Where applications are filed on the sameday, the pre liminary approval, after examination, and the publicationshall be made for the trademark which was the earliest used, and theappl ications of the others shall be refused and their trademarks shall not be published.Article 19.Any person may, within three months from the d ate of the publication, filean opposition against the trademark that has, after examination, beenpreliminarily approved. If no oppositi on has been filed, or if it isdecided that the opposition is not justified, the registration shall beapproved, a certificate of tra demark registration shall be issued and thetrademark shall be publish ed. If it is decided that the opposition isjustified, no registra tion shall be approved.Article 20.The Trademark Review and Adjudic ation Board, established under theadministrative authority for industry and commerce under the StateCouncil, shall be responsibl e for handling trademark disputes.Article 21.Where the application for registration of a trademark is refused and nopublication of the tr ademark is made, the Trademark Office shall notifythe applicant of the same in writing. Where the applicant is dissatisfied,he may, withi n fifteen days from receipt of the notification, apply for areview. T he Trademark Review and Adjudication Board shall make a finaldecis ion and notify the applicant in writing.Article 22.Where an opposition is filed against the trademark that has, afterexamination, be en preliminarily approved and published, the TrademarkOffice shal l hear both the opponent and applicant state facts and groundsand sha ll, after investigation and verification, make a decision. Whereany party is dissatisfied, he may, within fifteen days from receipt of th enotification, apply for a review, and the Trademark Review andAdjudication Board shall make a final decision and notify both theopponent and applicant in writing.
Chapter IV. Renewal, Assignment and Licensing of Registe redTrademarksArticle 23.The period of validity of a registered trade mark shall be ten years,counted from the date of approval of the r egistration.Article 24.Where the registrant intends to continue to use the registered trademarkbeyond the expiration of the period of validity, an application forrenewal of the registration shall be ma de within six months before thesaid expiration. Where no applicati on therefor has been filed within thesaid period, a grace period of six months may be allowed. If noapplication has been filed at the expiration of the grace period, theregistered trademark sh all be cancelled.The period of validity of each renewal of registratio n shall be ten years.Any renewal of registration shall be published af ter it has been approved.Article 25.Where a registered trademark is as signed, both the assignor and assigneeshall jointly file an applicat ion with the Trademark Office. The assigneeshall guarantee the qual ity of the goods in respect of which theregistered trademark i s used.The assignment of a registered trademark shall be published aft er it hasbeen approved.Article 26.Any trademark registrant may, by s igning a trademark license contract,authorize other persons to use his registered trademark. The licensorshall supervise the qualit y of the goods in respect of which the licenseeuses his registered t rademark, and the licensee shall guarantee thequality of the goo ds in respect of which the registered trademark is used.Where any part y is authorized to use a registered trademark of anotherperson, th e name of the licensee and the origin of the goods must beindica ted on the goods that bear the registered trademark.The trademark lice nse contract shall be submitted to the Trademark Officefor record.
Chapter V. Adjudication of Disputes Concerning Registered TrademarksArticle 27.Where a registered trademark stands in violati on of the provisions ofArticle 8 of this Law, or the registration of a trademark was acquired byfraud or any other unfair means, the Tr ademark Office shall cancel theregistered trademark in question; a nd any other organization or individualmay request the Trademark Rev iew and Adjudication Board to make anadjudication to cancel such a registered trademark.In addition to those cases as provided for in the preceding paragraph, anyperson disputing a registered trademark ma y, within one year from the dateof approval of the trademark registrat ion, apply to the Trademark Reviewand Adjudication Board for adjudic ation.The Trademark Review and Adjudication Board shall, after receip t of theapplication for adjudication, notify the interested parties and requestthem to respond with arguments within a specified period .Article 28.Where a trademark, before its being approved for registra tion, has beenthe object of opposition and decision, no application for adjudication maybe filed based on the same facts and grounds.Artic le 29.After the Trademark Review and Adjudication Board has made a finaladjudication either to maintain or to cancel a registered trademark, itshall notify the interested parties of the same in writi ng.

Administration of the Use of TrademarksArticle 30.W here any person who uses a registered trademark has committed any of thefollowing, the Trademark Office shall order him to rectify the si tuationwithin a specified period or even cancel the registered tradema rk:(1) Where any word, device or their combination of a registered tr ademarkis altered unilaterally (that is, without the required registra tion);(2) where the name, address or other registered matters conce rning theregistrant of a registered trademark are changed unilateral ly (that is,without the required application);(3) where the register ed trademark is assigned unilaterally (that is,without the requir ed approval); and(4) where the registered trademark has ceased to be used for threeconsecutive years.Article 31.Where a registered t rademark is used in respect of the goods that havebeen roughly or poorly manufactured, or whose superior quality has beenreplaced by inferior quality, so that consumers are deceived, theadminist rative authorities for industry and commerce at different levelsshal l, according to the circumstances, order rectification of the situation within a specified period, and may, in addition, circulat e anotice of criticism or impose a fine, and the Trademark Office m ay evencancel the registered trademark.Article 32.Where a registered trademark has been cancelled or has not been renewed atthe expiration, the Trademark Office shall, during one year from the dateof the canc ellation or removal thereof, approve no application for theregistr ation of a trademark that is identical with or similar to the saidtra demark.Article 33.Where any person violates the provisions of Article 5 of this Law, thelocal administrative authority for industry and commerce shall order himto file an application for the registration within a specified period, andmay, in addition, impose a fine.Article 34.Where any person who uses an unregistered trademark has committed any ofthe following, the local administrative authority for in dustry andcommerce shall stop the use of the trademark, order him t o rectify thesituation within a specified period, and may, in addi tion, circulate anotice of criticism or impose a fine:(1) where the trademark is falsely represented as registered;(2) where any provision of Article 8 of this Law is violated; and(3) where the manufacture is rough or poor, or where superior quality isreplaced by inferior qua lity, so that consumers are deceived.Article 35.Any party dissatisfied with the decision of the Trademark Office to cancela registered trade mark may, within fifteen days from receipt of thecorresponding notice, apply for a review. The Trademark Review andAdjudicati on Board shall make a final decision and notify the applicant inwritin g.Article 36.Any party dissatisfied with the decision of the administ rative authorityfor industry and commerce to impose a fine under the provisions of Article31, Article 33 or Article 34 may, within fifteen days from receipt of thecorresponding notice, institute legal proceed ings with the people's court.If there have been instituted no legal pr oceedings or made no performanceof the decision at the expiration of the said period, the administrativeauthority for industry and commer ce may request the people's court forcompulsory execution thereof.
Chapter VII. Protection of the Exclusive Rights to Use Registe red TrademarksArticle 37.The exclusive right to use a registered t rademark is limited to thetrademark which has been approved for re gistration and to the goods inrespect of which the use of the trad emark has been approved.Article 38.Any of the following acts shall be an infringement of the exclusive rightto use a registered trademark:( 1) to use a trademark that is identical with or similar to a registe redtrademark in respect of the same or similar goods withou t theauthorization of the proprietor of the registered trademark;(2) to sell goods that he knows bear a counterfeited registered trademark ;(3) to counterfeit, or to make, without authorization, representation s ofa registered trademark of another person, or to sell such repres entationsof a registered trademark as were counterfeited, or m ade withoutauthorization;(4) to cause, in other respects, prejudice to the exclusive right ofanother person to use a registered trad emark.Article 39.Where any party has committed any of such acts to inf ringe the exclusiveright to use a registered trademark as provided f or in Article 38 of thisLaw, the infringee may request the administra tive authority for industryand commerce at or above the county level for actions. The administrativeauthority for industry and commerce s hall have the power to order theinfringer to immediately stop the infringing act and to compensate theinfringee for the damages suffered by the latter. The amount ofcompensation shall be the profit that the infringer has earned through theinfringement during t he period of the infringement or the damages that theinfringee has suf fered through the infringement during the period of theinfringement. Where the infringement of the exclusive right to use aregistere d trademark is not serious enough to constitute a crime, theadmin istrative authority for industry and commerce may impose a fine.Where any interested party is dissatisfied with the decision of handlingma de by the administrative authority for industry and commerce to ord erhim to stop the infringing act or to impose a fine, he may, within f ifteendays from receipt of the notice, institute legal proceedings with thepeople's court. If there have been instituted no legal proce edings or madeno performance of the decision (to impose a fine) at the expiration of thesaid period, the administrative authority for indust ry and commerce shallrequest the people's court for compulsory execut ion thereof.Where the exclusive right to use a registered trad emark has beeninfringed, the infringee may institute legal proceedin gs directly with thepeople's court.Article 40.Where any party passes o ff a registered trademark of another person, andthe case is so serio us as to constitute a crime, he shall be prosecuted,according to la w, for his criminal liabilities in addition to hiscompensation for the damages suffered by the infringee.Where any party counter feits, or makes, without authorization,representations of a re gistered trademark of another person, or sells suchrepresentations of a registered trademark as were counterfeited, or madewithout authori zation, and the case is so serious as to constitute acrime, he shall be prosecuted, according to law, for his criminalliabili ties in addition to his compensation for the damages suffered bythe infringee.Where any party sells goods that he knows bear a counterfei ted registeredtrademark, and the case is so serious as to constitute a crime, he shallbe prosecuted, according to law, for his criminal l iabilities in additionto his compensation for the damages suffered by the infringee.
Chapter VIII. Supplementary ProvisionsArticle 41.Any applicatio n for a trademark registration and for other mattersconcerning a trademark shall be subject to payment of the fee asprescr ibed. The schedule of fees shall be prescribed separately.Article 42.T he Implementing Regulations under this Law shall be drawn up by theadministrative authority for industry and commerce under the StateCouncil. They shall enter into force after they have been submi tted to andapproved by the State Council.Article 43.This Law shall ent er into force on March 1, 1983. The "RegulationsGoverning Trad emarks" promulgated by the State Council on April 10, 1963shall be a brogated on the same date, and any other provisions concerningtradem arks contrary to this Law shall cease to be effective at the sameti me.Trademarks registered before this Law enters into force shall conti nue tobe valid.
