IntroductionMigrating to New Zealand
This section gives you a brief summary of the immigration requirement s you need to meet to be able to live in New Zealand. It is designed t o enable you to decide if you wish to obtain the full information nece ssary to make an application for residence in New Zealand.
If, after reading this section, you want to get full details about app lying for residence, you should request a residence application pack f rom any New Zealand Immigration Service (NZIS) office or download it f rom this site.
Residence in New Zealand
Under the Immigration Act 1987, every person who wishes to immigrate to New Zealand needs to apply for residence. Residence entitles you to live, study and work indefinitely in New Zealand.
If you wish to leave New Zealand temporarily, you must have a valid re turning resident's visa in your passport to ensure your re-entry to Ne w Zealand as a resident. You will be issued your first returning resid ent's visa when residence is approved.
New Zealand Citizenship Enquiries
In New Zealand, residence and citizenship are different. If you are g ranted residence you retain your original citizenship, and may apply f or New Zealand citizenship later.
The NZIS does not administer citizenship law. Enquiries about New Zeal and citizenship and passports should be addressed to the Department of Internal Affairs or the appropriate section of a New Zealand consular or diplomatic office.
Do you need to Apply for Residence?
Under the Immigration Act 1987, some people do not have to apply for r esidence to live in New Zealand. They include:
New Zealand citizens, who must show a valid New Zealand passport on en tering New Zealand;
Australian citizens, who must show a valid Australian passport on ente ring New Zealand.
Australian permanent residents entering New Zealand with a current Aus tralian resident return visa will be granted a residence permit on arr ival. Australian citizens and Australian permanent residents are subje ct to section 7 of the Immigration Act 1987, which relates to good cha racter.
How are Applications Assessed?
Applications for residence are assessed by the NZIS. Under the Immigr ation Act 1987, the Minister of Immigration sets Government residence policy. The NZIS assesses applications according to the rules of this policy, and is not allowed to make exceptions. If an application is de clined, the applicant may ask the independent Residence Appeal Authori ty to review the decision.
Applications must have a high standard of documentation to be accepted for processing, so it is important that you read and understand the i nformation available, especially the Application Guide. You are respon sible for supplying information which demonstrates that you meet polic y.
You may apply for residence from inside New Zealand if you are in New Zealand lawfully, on a temporary permit. You may also apply for reside nce from outside New Zealand.
There is an application fee for all categories of residence applicatio n. These fees are not refundable and can change without notice. Outsid e New Zealand, fees are usually paid in local currency. Fees informati on is included in the residence pack, or can be obtained by contacting the NZIS or by checking the office where you will lodge your applicat ion.
Which Category Applies to You?
The following are the four main categories for residence applications .
General Skills Category
The General Skills Category is a points system. Applicants score point s for a number of factors such as qualifications, work experience and age.
Business Investor Category
The Business Investor Category is a points system. Applicants score po ints for factors such as investment funds, business experience, qualif ications and age.
Family Category
The Family Category is available to those applicants who:
are in a genuine and stable marriage, de facto or homosexual relationship with a New Zealand citizen or resident; or
have immediate family members who are New Zealand citizens or re sidents and who live permanently in New Zealand.
Humanitarian Category
The Humanitarian Category is available to those applicants:
who have the support of a close family member who is a New Zealan d citizen or residence permit holder; and
whose circumstances are causing serious physical harm or serious emotional harm to the applicant or a New Zealand party that can only b e resolved by the applicant being granted residence in New Zealand.
Which Family Members can be Included?
Principal Applicant
The principal applicant is:
the person assessed against the policy criteria
the primary contact person.
Spouses and Partners
A spouse who is legally married to the principal applicant may be incl uded in the application. A de facto partner may be included if the pri ncipal applicant and de facto partner have been living in a genuine an d stable relationship for at least two years at the time of applicatio n. Homosexual partners may not be included in an application and are o nly eligible for residence if their partner is a New Zealand citizen o r New Zealand resident.
Dependent Children
Dependent children of the principal applicant or spouse/ partner may b e included if they:
are single and aged 19 years or younger; and
have no children of their own; and
are totally or substantially reliant on their parents or guardians for financial support (whether living with them or not).
Custody of Dependent Children
If the parents of a dependent child included in a residence applicatio n are separated or divorced, the applicant parent must have the right to remove the dependent child from the country in which rights of cust ody or visitation have been granted. Such dependent children will not be granted residence unless satisfactory evidence of the right to remo ve the child is submitted.
Customary Adoptions
Children who have been adopted, informally and according to custom, at an early age by members of their extended family are regarded as memb ers of the host family into which they were adopted.
Good Health
You and your accompanying family members must be in good health, whic hever category you apply under. This is to ensure that you:
are not likely to be a danger to public health; and
are not likely to be a burden on the health services; and
are fit for the purpose of entry.
In order to check that you and your family are in good health, you are required to undergo medical examinations and tests in order to comple te the NZIS medical and chest x-ray certificates. These certificates w ill be referred to an NZIS consultant physician for an opinion if nece ssary.
The following overseas posts use a selected panel of medical practitio ners or institutions to perform immigration medical examinations. Cont act your closest office to check for the names and addresses of the ap proved panels.

Good Character
You and your accompanying family members must be of good character, w hichever category you apply under.
In order to prove that you and your family are of good character you a re required to provide, for everyone 17 years of age and over:
police certificates from your country of citizenship; and
police certificates from any country you have been in for 12 months or more in the last 10 years, whether in one or more visits.
The residence pack and forms section contain information on how to ob tain a police certificate from most countries. Among the good characte r requirements are those found in section 7 of the Immigration Act, 19 87. Some of the people who may be refused residence under section 7 ar e those who:
have ever been convicted and sentenced to imprisonment for 5 years or more;
have been convicted and sentenced to imprisonment for 12 months or mor e during the preceding 10 years;
have ever been deported from New Zealand or any other country;
there is reason to believe may be associated with criminal groups, or may constitute a danger to New Zealand.
English Language Requirements
All principal applicants and any accompanying family members aged 16 years and over must meet the specified standard of English language if applying under the General Skills and Business Investor categories. Y ou must, therefore, produce evidence of either:
meeting band level 5 (for General Skills) or band level 4 (for Busines s Investor) in each of the four modules of the International English L anguage Testing System (IELTS) General Module or Academic Module; or
having an English language background. A full list of acceptable evide nce of having an English language background is found in the Applicati on Guide.
Principal applicants within the General Skills category must meet the English language standard. If accompanying family members from the Gen eral Skills category, do not meet the acceptable English language stan dard at the time the application is approved, they must pre-purchase E nglish language training. This option is also available to principal a pplicants within the Business Investor category.
The cost of English language training is dependent on the applicant's current level of English. Eligible applicants who do not provide any e vidence of English ability will be required to purchase the maximum le vel of English language training.

Skill New Zealand will undertake the purchasing of the English languag e training and manage the contract on behalf of the migrant, who will be able to select a training provider, either from information provide d by Skill New Zealand, or independently.
The option of pre purchasing English language training is also availab le to principal applicants in the General Skill category who:
currently hold work permits; and
are currently employed in New Zealand; and
have been working lawfully in New Zealand for at least one year; and
meet all other General Skills category residence requirements.
The objective of this change is to reduce barriers to families and to those clearly employable within New Zealand, while helping to improve their English language skills.
Settlement Fee
IMPORTANT NOTICE - NEW FEES
The settlement services fee which applied to residence applicants in t he General Skills and Business Investor categories ceased on 1 July 19 98. This fee has been replaced by a new fee and a levy:
Migrant levy - this is NZ$180 for each person included in an applicati on, up to a maximum of NZ$720. This fee applies only to residence appl ications in the General Skills and Business Investor categories.
Settlement information fee - this is NZ$90 for the principal or sole a pplicant in a residence application. This levy applies to all categori es of residence application, including Family and Humanitarian categor ies, except applicants granted residence because they are refugees or citizens of Western Samoa.
The settlement information fee and migrant levy are paid after notific ation of approval has been given and must be paid before residence per mits are granted or residence visas are issued.
The new settlement information fee and migrant levy took effect on 1 J uly 1998.
Applicants who have already been sent letters advising of approval not ifying them that they must pay the old settlement services fee may pay this old amount, even if they pay after 1 July 1998. Applicants who h ave already been notified of approval in a category not previously sub ject to a fee may be granted residence without having to pay the new f ee.

Income Support
You are expected to have sufficient personal resources to maintain yo urself and your dependants for at least your first 24 months as a resi dent in New Zealand. During this period, income support will only be g ranted in cases of hardship.
